TEHSEEKERS PTE. LTD.

These Terms and Conditions constitute a legally binding agreement between you and TEHSEEKERS PTE. LTD., hereinafter referred to as TehSeekers. By registering, booking, making payment, joining any communication group, accessing any information, or participating in any activity organised, facilitated, or promoted by TehSeekers, you acknowledge and agree to be bound by these Terms and Conditions. If you do not agree, you must not register, book, or participate.

1. Formation of Contract

Your registration, booking, payment, or participation constitutes unconditional acceptance of these Terms and Conditions and creates a legally binding contract between you and TehSeekers. Where you register or make payment on behalf of other individuals, you represent and warrant that you are authorised to bind all such participants to these Terms and Conditions and that each participant has read, understood, and accepted them.

These Terms and Conditions incorporate by reference the TehSeekers Privacy Policy, which forms an integral part of this agreement.

2. Booking, Pricing, and Payment

All bookings are subject to availability and are confirmed only upon receipt of the required full or partial payment as specified for the relevant activity. Prices, inclusions, and itineraries are subject to change at any time prior to confirmation.

Payments are processed through third party payment service providers. TehSeekers does not store full payment card details and shall not be responsible for errors, delays, failures, or losses arising from third party payment systems.

3. Cancellations, Refunds, and Non Recoverable Costs

Cancellation and refund terms may vary by activity and will be communicated where applicable. Unless expressly stated otherwise in writing, cancellations made thirty days or more before departure are eligible for a refund minus administrative and non recoverable costs. Cancellations made between fifteen and twenty nine days before departure are eligible for a refund of fifty percent of amounts paid. Cancellations made within fourteen days of departure are not eligible for any refund.

Refunds, where applicable, will be processed within a reasonable timeframe and may take up to fourteen working days. TehSeekers reserves the right to deduct costs already incurred including permits, accommodation, transport, guide fees, and administrative expenses.

4. Nature of Activities and Assumption of Risk

You acknowledge and accept that trekking, hiking, travel, and adventure activities involve inherent, unpredictable, and potentially serious risks. These risks include, without limitation, physical injury, illness, altitude related conditions, environmental hazards, wildlife encounters, adverse weather, accidents, equipment failure, transportation incidents, permanent disability, or death.

You knowingly, voluntarily, and expressly assume full responsibility for all such risks, whether known or unknown, foreseeable or unforeseeable, and regardless of cause.

5. Fitness, Health, and Personal Responsibility

You represent and warrant that you are physically and mentally fit to participate and that you have not concealed or misrepresented any medical, physical, or psychological condition that may affect your ability to participate safely. You are solely responsible for assessing your own capability, limitations, and readiness.

TehSeekers does not provide medical advice, diagnosis, or treatment and relies entirely on information provided by participants. You agree that failure to disclose relevant health information shall be at your own risk and responsibility.

6. Compliance with Instructions and Conduct

You agree to comply at all times with safety instructions, rules, guidelines, and directions issued by TehSeekers, its representatives, guides, or partners. TehSeekers reserves the absolute right to deny participation, remove, or exclude any participant whose conduct is deemed unsafe, disruptive, non compliant, or detrimental to the group or activity, without refund or compensation.

7. Limitation and Exclusion of Liability

To the maximum extent permitted under Singapore law, TehSeekers, its directors, officers, employees, volunteers, coordinators, agents, representatives, and partners shall not be liable for any loss, damage, injury, illness, delay, expense, emotional distress, disability, death, or consequential loss arising directly or indirectly from participation in any activity.

This exclusion applies irrespective of cause, including negligence, breach of duty, acts or omissions of third parties, weather conditions, political conditions, natural events, or unforeseen circumstances.

8. Release and Waiver of Claims

You irrevocably and unconditionally release, waive, and discharge TehSeekers from all claims, demands, actions, causes of action, or proceedings of any nature arising out of or in connection with your participation, whether arising before, during, or after the activity, to the fullest extent permitted by law.

9. Indemnity

You agree to fully indemnify and hold harmless TehSeekers against any and all claims, liabilities, losses, damages, costs, and expenses, including legal fees, arising from your participation, breach of these Terms and Conditions, negligence, misconduct, or failure to comply with instructions or applicable laws.

10. Third Party Services

Certain services may be provided by independent third parties including guides, transport operators, accommodation providers, or equipment suppliers. TehSeekers acts solely as a facilitator and shall not be responsible or liable for the acts, omissions, delays, failures, or defaults of such third parties.

11. Changes, Delays, and Force Majeure

TehSeekers reserves the right to modify itineraries, routes, schedules, or cancel activities where necessary for safety, operational, or logistical reasons. TehSeekers shall not be liable for delays, changes, or cancellations caused by events beyond reasonable control including extreme weather, natural disasters, government actions, epidemics, political instability, or trail closures.

Such changes shall not give rise to any right to compensation or damages.

12. Insurance

You acknowledge that participation is undertaken at your own risk and that adequate personal, medical, travel, and evacuation insurance is strongly recommended and may be mandatory for certain activities. TehSeekers does not provide insurance unless expressly stated in writing.

13. Photography, Video, and Media Use

You grant TehSeekers an irrevocable, royalty free, and unrestricted right to use photographs, videos, audio recordings, or other media captured during activities for promotional, marketing, educational, or informational purposes without compensation or further consent.

14. Minors

For participants under eighteen years of age, a parent or legal guardian must provide consent and accepts full responsibility, liability, and assumption of risk on behalf of the minor.

15. Privacy and Data Protection

Personal data is collected, used, disclosed, and protected in accordance with the TehSeekers Privacy Policy. By accepting these Terms and Conditions, you confirm that you have read and agreed to the Privacy Policy.

16. Intellectual Property

All content, materials, images, logos, text, and intellectual property associated with TehSeekers are owned or licensed by TehSeekers. Unauthorised use, reproduction, or distribution is strictly prohibited.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Singapore. You irrevocably submit to the exclusive jurisdiction of the courts of Singapore.

18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

19. Acknowledgement and Acceptance

By registering, booking, or participating, you confirm that you have read, understood, and voluntarily accepted these Terms and Conditions in full, and that you participate entirely at your own risk.
